The Guidelines Regulating Debt Collectors & Your Consumer Rights

I found this great video from the FTC explaining our rights as consumers when it comes to debt collectors and their methods. Debt Collection Agencies are notorious for crossing the line and it is good to know what your rights are and how to deal with them.

A few of the highlights from the video…

  • Debt Collectors are not allowed to call before 8am or after 9pm.
  • They can not curse or insult you.
  • They can’t lie or make up false consequences.
  • Debt collectors can not call you at work if your employer doesn’t allow it. But, of course, the debt collectors won’t know that it isn’t allowed unless you inform them.
  • Consumers have the right to stop debt collectors from calling simply by writing them a letter requesting it.

Good and informative video.

I would be careful about having collectors stop calling unless I specify that future communications will be through the mail. No communication at all could be a trigger for a law suit.

Also, the FTC (paragraph 809 of the Fair Debt Collection Practices Act) requires collectors to send a written validation notice within five days after contacting you. Insist that the collector do so.
